Terms of Service

Acceptance of Terms

These Terms of Service ("Terms") govern your use of nabuha.com and any related services, forms, accounts, or applications (together, the "Site"), operated by NABUHA, based in Union City, California. By using the Site, submitting a form, creating an account, applying to Sanctum Select, booking a workshop, or purchasing a product, you agree to these Terms. If you don't agree, please don't use the Site.

You must be at least 13 years old to create an account or submit a form on the Site. If you are under 18, you may only use the Site with the involvement of a parent, guardian, or, in a school setting, your school.

Using the Site

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Submit false, misleading, or fraudulent information through any form.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site, its accounts, or its infrastructure.
  • Scrape, harvest, or bulk-collect data from the Site, including Sanctum Select listings, without permission.
  • Impersonate NABUHA, a NABUHA team member, or another user.

We may suspend or terminate access to the Site or an account, at our discretion, for conduct that violates these Terms or that we believe harms NABUHA, other users, or third parties.

Confidentiality and Non-Disclosure

In the course of using the Site, you may come across information that is not public: unreleased designs, product plans, creative or story concepts, business strategy, pricing, vendor and partner details, internal processes, or personal information about NABUHA team members or community members ("Confidential Information"). By using the Site, submitting a form, or creating an account, you agree to keep any Confidential Information you access confidential, use it only for the purpose it was shared with you, and not disclose it to any third party without NABUHA's written consent.

This obligation applies with more weight, and in more detail, to anyone who joins NABUHA as a team member, collaborator, volunteer, or intern through our Join Our Team application or a similar arrangement. Submitting that application means you additionally agree that: you will protect any trade secrets, unreleased creative or business work, and personal information you're given access to with reasonable care; you will not use Confidential Information for your own benefit or any purpose outside your work with NABUHA; this obligation continues after your involvement with NABUHA ends, for as long as the information stays non-public; and, if NABUHA asks, you will return or delete any Confidential Information in your possession.

Confidential Information does not include information that is or becomes publicly available through no fault of yours, that you already lawfully knew before NABUHA shared it, that you develop independently without using it, or that you're required to disclose by law (in which case you'll give NABUHA reasonable notice first, where legally possible). A breach of this section may cause harm that money alone can't fix, so NABUHA can seek a court order to stop the breach in addition to any other remedy available.

Sanctum Select

Sanctum Select is a curated directory of collaborators, vendors, and artists NABUHA has worked with directly. Submitting an application does not guarantee a listing. NABUHA reviews every application and decides, at its sole discretion, whether to approve, decline, or remove a listing at any time, including after approval, if the listing no longer reflects NABUHA's standards or working relationship with that person or business.

By submitting a Sanctum Select application, you grant NABUHA a non-exclusive, royalty-free license to display the information you provide (name, business name, category, description, links, and any submitted images) on the Site and in related marketing materials, until you ask us to remove it.

Listings are informational and do not constitute an endorsement of every aspect of a listed business's work, nor a guarantee of quality, availability, or outcome. NABUHA is not a party to any transaction between you and a Sanctum Select listing.

Team, Collaborator, and Volunteer Applications

Submitting a Join Our Team application does not guarantee a role, and roles described on that page (or in the application itself) are opportunities, not offers of employment. NABUHA reviews every application and decides, at its sole discretion, who to bring on, in what capacity, and for how long. Most collaborator, volunteer, and intern roles are unpaid or stipend-based unless a specific paid arrangement is agreed in writing; any compensation, hours, and role scope are set out separately once NABUHA and the applicant agree to move forward.

Work you create specifically for NABUHA as part of a team, collaborator, volunteer, or intern role (designs, content, writing, code, or other creative work made for NABUHA's projects) belongs to NABUHA, unless you and NABUHA agree otherwise in writing. This does not apply to your own personal portfolio work, prior work, or anything you create outside the scope of your role with NABUHA.

Submitting this application also means you agree to the confidentiality obligations described above, which apply whether or not you're ultimately selected to join the team.

Workshops

Workshop bookings (campus or community) are confirmed once NABUHA and the requesting school or organization agree on scope, date, and payment terms in writing (including by email). Workshop pricing starts at $150/hour and varies by scope; final terms are set per engagement, not by this page.

Cancellations, rescheduling, and payment terms are governed by the specific agreement made for that workshop. In the absence of a specific written agreement, NABUHA reserves the right to require payment for work already performed (curriculum development, prep time) if a booking is cancelled with less than 7 days' notice.

Schools and organizations booking a workshop are responsible for confirming their own compliance obligations (background checks, FERPA, insurance requirements) with their institution; NABUHA will cooperate in good faith with reasonable, standard requests.

Product Purchases

Fragrances, merch, and apparel purchased through NABUHA are sold as described at the time of purchase. Custom garment orders require a $50 non-refundable deposit to begin design work; the remaining balance is collected per the payment schedule communicated at booking (typically half before production, remainder at final fitting). All custom garment payments are non-refundable once work has begun, given the bespoke nature of the work.

For non-custom products (fragrances, ready-to-wear merch), contact sanctum@nabuha.com about a specific order; returns and exchanges are handled case by case and are not guaranteed unless required by law.

Vibe and Thrive Events

Attending Vibe and Thrive or any NABUHA event means you agree to follow the venue's rules and any safety instructions given on-site. NABUHA may use photos or video taken at events for marketing purposes; if you don't want to appear in event media, tell a NABUHA team member at the event or email sanctum@nabuha.com in advance.

Vendor and performer participation is subject to separate terms communicated at the time of booking, including any applicable table fees, insurance requirements, and performance rights confirmations.

Intellectual Property

All content on the Site, including text, graphics, logos, photography, garment designs, and the NABUHA name and marks, is owned by NABUHA or its licensors and protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without NABUHA's written permission, except for normal personal, non-commercial use (such as sharing a link).

If you believe content on the Site infringes your copyright, email sanctum@nabuha.com with a description of the work, its location on the Site, and your contact information, and we'll respond promptly.

Disclaimers

The Site and all products, workshops, and services are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Wellness and identity-focused workshop content is educational and creative in nature and is not medical, psychological, or therapeutic advice.

Limitation of Liability

To the fullest extent permitted by law, NABUHA is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, products, workshops, or events, even if NABUHA has been advised of the possibility of such damages. NABUHA's total liability for any claim arising from these Terms is limited to the amount you paid NABUHA in the 12 months before the claim arose.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Alameda County, California, and you consent to that venue.

Changes to These Terms

We may update these Terms as the Site or our offerings change. We'll update the effective date above when we do. Continued use of the Site after a change means you accept the updated Terms.
